Elder Law
“Elder law” encompasses several areas of law focused on “senior
Americans”, including estate planning, long-term care planning,
management of assets in the event of incapacity and medical assistance
(Medicaid) planning. In general, properly drafted Wills and Revocable
Trusts and Powers of Attorney are the first step in coordinating your
estate plan. But for many, it may be necessary to obtain advice on
issues of long-term care such as nursing home admission agreements and
long-term care insurance policies. For others, Medicaid planning
(government funding of nursing home costs) may be a desirable option,
particularly where there is opportunity to plan. This may involve
transfers of assets to children, transfers between the
institutionalized spouse and the community spouse and the protection of
the residence from Maryland’s lien law. These matters are generally not
intuitive and require delicate planning with precision and care. Our
office has successfully assisted many clients with these issues.
